Why South Carolina Requires an Attorney at Every Closing
South Carolina is one of a small number of states that mandates licensed attorney supervision for every real estate closing, whether the transaction is financed through a lender or paid in cash. The South Carolina Supreme Court established this requirement in State v. Buyers Service Co., holding that closing activities constitute the practice of law and can’t be performed by unlicensed parties.
Under the South Carolina Consumer Protection Code, the buyer has the right to select the closing attorney, and lenders and other parties in the transaction must honor that choice. The closing attorney examines the title, traces the chain of ownership, identifies any liens or encumbrances, confirms that the title is transferable, coordinates the disbursement of funds, and files the recorded deed with the Charleston County Register of Deeds. Choosing your own closing attorney rather than accepting whoever a lender defaults to gives you an advocate whose primary obligation runs to you.
